Client Agreement

Service Terms & Conditions between Client & The Sister Sitters INC.

This agreement is entered on this day of between The Sister Sitters INC (hereinafter referred to as “the Provider”) and the parent/legal guardian (hereinafter referred to as “the Client”). The purpose of this agreement is to define the terms and conditions under which the Provider will arrange babysitters for the Client’s event. The Client understands that the referred babysitters are not employees, officers or partners of The Sister Sitters INC as a corporation. The Client agrees that they are signing for all below named children and their parent/s and/or guardian/s/on the agreement.

How to Reserve a Sitter (Always a 3-hour minimum):

Any and all babysitter requests are to be made directly through the Provider via website, email or phone. Upon receiving the signed contract, credit card information and any and all fees are paid, the Provider will be hired to reserve a referred babysitter or babysitters for the Client. All charges and fees will be charged by the Provider via credit card with an additional 4% credit card processing fee for U.S. credit cards and 5% outside the U.S. To guarantee placement, all dates and times should be reserved with as much notice as possible, suggesting a minimum of 48 hours’ notice. As soon as a babysitter/s are reserved, their name/s, contact information will be provided and photos / bios are available on our website. Once a babysitter/s have been assigned, it is the Provider's responsibility to contact the Client to confirm the time, location and if parking is available. If an unforeseen event arises and the reserved babysitter/s is/are unavailable for the dates and times requested, the Provider will do everything they can to find a replacement, however it does not guarantee a replacement will be found in such an event. In the event that this may occur, the hourly rate for the babysitters will be refunded. The Client agrees to not contact any referred babysitter met through the Provider to reserve them for any date and time without approval of the Provider.

Babysitter Qualifications:

All babysitters have been personally interviewed and every reasonable effort has been made to accurately screen for criminal history, driving history, work experience, valid First Aid / CPR certification, minimum of 2 year of childcare experience, 18 years or older, social security verification and legal status, however the Provider makes no warranty on the babysitter’s character or capabilities. The Client agrees to hold The Sister Sitters INC innocent and not liable, in any current or future cause of action resulting from any acts of any babysitter referred by The Sister Sitters INC.

Medical and Emergency Care:

The parents or legal guardian agree that any babysitter referred to them by the Provider will not administer any medications or medical care without prior consent from the parents or legal guardian. If a prescription needs to be administered, label must show that it is prescribed to the child only and be current. If there is an emergency, while the child(ren) are in the referred babysitter’s care, the babysitter is allowed to perform First Aid / CPR as taught. The family will not hold the babysitter and/or the Provider, its directors, officers, employees and successors, liable from any and all claims that may emerge from care. If babysitter’s First Aid and CPR efforts are not successful, the parents or legal guardian gives consent to contact 911 emergency services. The babysitter will contact the parents or legal guardian as soon as they are able.

To protect the health and safety of our sitters and other families, we are unable to provide care for children who are contagious, have a fever, or are experiencing ongoing vomiting or diarrhea.

Children must be fever-free and symptom- free for at least 24 hours prior to the start of care. If a child becomes ill during a booking, the sitter reserves the right to end services early and request that a parent return.

In the event of a cancellation due to illness, deposits remain non-refundable, as the sitter and agency has reserved time exclusively for your family and is unable to accept another booking.

Additionally, care will not be provided on days when a parent or household member is staying home because of illness.

Rates and Payment Agreement:

The Client will provide a credit card number at the time of booking the reservation and authorize the Provider to charge the credit card a 50% deposit and for any and all fees. The Client agrees that the referred babysitter/s will confirm with the Provider via "CLOSEOUT FORM" on website, when the parents/guardians returned during each shift and the Provider will pay the referred babysitter on their behalf accordingly after services have been rendered. An additional 4% credit card processing fee for U.S. credit cards and 5% outside the U.S. will be also be applied when the credit card is charged.

Booked Hours and Time Changes:

All reserved hours secure the sitter's availability for the scheduled time. Once a booking is confirmed, the start and end times are locked in and cannot be shortened. Requests to arrive later, leave earlier, or reduce the total hours after booking will still be charged for the originally reserved time, as the sitter and agency have blocked off that portion of the schedule.

Additional hours may be added either prior to the sitter's arrival or during the service, pending sitter approval.

Local Date Night Babysitter / Part-time and Full-time Nanny Rates:

The hourly babysitter rate is $28 per hour for 1 to 2 children & $5 per hour for each additional child.

The hourly nanny rate is $33 per hour for 1 to 2 children & $5 per hour for each additional child.

If booking a service within a 48 hour timeframe, there will be a $20 service fee added to accommodate your need for a sitter.

If this service is for multiple families there is a $25 fee per additional family.

Additional Fees: Gratuities: are optional and would be 100% payable to the babysitter/nanny.

Theme Park / Hotel / Resort Babysitter Rates:

The hourly babysitter rate is $30 per hour for 1 child & $5 per hour for each additional child.

Additional Fees: If parking is not free it will be billed to the Client and if the shift is 4 hours or longer a $20 per diem for food for the babysitter will be charged unless provided by the Client.

If booking a service within a 48 hour timeframe, there will be a $20 service fee added to accommodate your need for a sitter.

If this service is for multiple families there is a $25 fee per additional family.

Gratuities: are optional and would be 100% payable to the babysitter.

Wedding / Special Events Babysitter Rates:

Each client will receive a customized package for your special event.

Cancellation / Rescheduling Policy: (Only for our babysitting services not nanny positions- you will note this in your Addendum C)

If a booking is cancelled 30 days or less prior to the schedule service date, 50% of the total fee is non-refundable. Cancellations made more than 30 days in advance will receive a full refund.

Rescheduling: A $20 fee applies per change. Rescheduled bookings must be used within 30 days and for the originally booked hours. Original sitter is not guaranteed.

State of Emergency Hurricane Policy: If the state issues a state wide emergency in your county, there will be no cancellation fee required. This is the only cancellation allowed without prior notice.

Parking:

If free parking is not available, the Client agrees to pay for the babysitter’s parking at any resort, hotel, theme park or venue.

Entertainment:

The babysitter/s will provide a small bag of entertainment, including books, games and crafts at no additional cost to resort / hotel babysitting shifts.

All disputes arising under this agreement shall be governed by and interpreted in accordance with the laws of Florida, without regard to principles of conflict of laws. The parties to this agreement will submit all disputes arising under this agreement to arbitration in Orange County, FL before a single arbitrator of the American Arbitration Association (“AAA”). The arbitrator shall be selected by application of the rules of the AAA, or by mutual agreement of the parties, except that such arbitrator shall be an attorney admitted to practice law Florida. No party to this agreement will challenge the jurisdiction or venue provisions as provided in this section. Nothing contained herein shall prevent the party from obtaining injunctive release.

Non-Solicitation:

As a Client of The Sister Sitters INC you understand that you will be introduced to The Sister Sitters Team Members and solicitating our members is strictly prohibited. The Sister Sitters INC is providing a service to the Client, Team Member and they have agreed not to provide any services to the Clients of The Sister Sitters INC.

Entire Agreement:

This agreement contains the entire agreement and understanding among the parties with respect to the subject matter here in and supersedes all prior agreements and understandings, oral or written, of any nature whatsoever with respect to the subject matter herein.
